Terms of Service
1. Acceptance of Terms
By accessing or using MyLA28 (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service & Disclaimer of Olympic Affiliation
MyLA28 is a scheduling tool and itinerary builder that provides information about events, locations, and travel times related to the 2028 Summer Olympics in Los Angeles. The Service offers both free and paid tiers. The paid tier provides access to advanced scheduler features as described on our Site.
3. Eligibility and User Accounts
3.1 Age Requirement
You must be at least 13 years old to use the Service. If you are between the ages of 13 and 18, you represent that you have obtained permission from a parent or legal guardian to use the Service. By registering for an account, you confirm that you meet these age requirements. We do not knowingly collect information from children under 13, and any account found to be registered by a user under 13 will be terminated immediately.
3.2 Account Registration
You may register using a unique username/password, via Google Login, or via Facebook Login (we receive your name and email as described in our Privacy Policy).
3.3 Accuracy
You agree to provide accurate, current, and complete information.
3.4 Security
You are responsible for maintaining the confidentiality of your login credentials. You are liable for all activities under your account.
3.5 Google Login & Facebook Login
You authorize us to access your Google account's basic profile information (name, email) as described in our Privacy Policy. For Facebook Login, you authorize us to access your name and email and agree to Facebook's Login Terms. Google's and Facebook's own terms and privacy policies govern their side of the login process.
3.6 One Account Per User
You may not create multiple accounts. If we detect that a single user has created multiple accounts (including to avoid paying for the paid tier), we reserve the right to terminate all duplicate accounts and retain only the oldest or most recently active account at our discretion. Repeat offenders may be permanently banned from the Service.
4. Paid Access - Pricing, Payment, and Taxes
4.1 Pricing
Access to the advanced scheduler tool is priced at $10.00 USD plus applicable taxes (the "Fee").
4.2 Payment Processing
All payments are processed by our third-party Payment Processor. You agree to provide accurate billing information. We do not store your full payment card details. We are PCI DSS compliant as a merchant (SAQ A).
4.3 Taxes
You are responsible for all taxes applicable to your purchase, including but not limited to sales tax, use tax, value-added tax (VAT), or goods and services tax (GST). Our payment processor will calculate and collect the appropriate taxes based on your billing address and applicable laws. If you are tax-exempt, you must provide valid tax exemption documentation before completing your purchase.
4.4 Currency
All Fees are charged in United States Dollars (USD). Your payment card issuer may apply currency conversion fees.
4.5 Access Duration
Upon successful payment, you will receive access to the paid advanced scheduler tool through the conclusion of the 2028 Summer Olympics. For purposes of these Terms, the "conclusion of the 2028 Summer Olympics" means the date of the official Closing Ceremony as announced by the LA28 Organizing Committee. After that date, your account will automatically revert to the free tier (or become inactive, at our discretion), and no further payments will be due.
4.6 No Unauthorized Sharing
Your paid access is for your personal, non-commercial use only. You may not share your login credentials with others to allow them to access the paid tier.
4.7 Commercial Use of Free Tier Prohibited
You may not use the free tier for any commercial purpose, including resale of scheduling data, event information, or itineraries, without our prior written consent.
5. Refund Policy
Purchases of the paid advanced scheduler tool are final. We do not offer refunds, exchanges, credits, or chargebacks for any reason, including but not limited to:
- You change your mind or no longer want the Service;
- You do not use the paid features after purchasing;
- You lose or forget your login credentials;
- Your account is suspended or terminated for violating these Terms;
- You experience technical issues with the Service (see Section 5.1 below for downtime remedy);
- You move to a different location or are unable to attend the Olympics;
- You dispute the charge with your payment card issuer on grounds other than fraud or unauthorized use of your card.
5.1 Downtime Remedy
If the paid advanced scheduler tool is unavailable for more than 7 consecutive days due to our error (excluding scheduled maintenance, third-party outages, or force majeure), we will extend your paid access by the same number of downtime days at no additional cost. This is your sole remedy for technical issues.
5.2 Olympics Cancellation or Major Change
If the 2028 Summer Olympics are permanently canceled more than 6 months before the scheduled start date, we will issue partial pro-rated refunds of $5.00 USD per paid user after deducting processing, development, and overhead costs. If the Olympics are postponed, rescheduled, or partially canceled, no refunds will be issued (your access will continue through the rescheduled dates). If the Olympics are canceled within 6 months of the start date, no refunds will be issued.
Because the paid tier provides immediate access to digital scheduling tools, and the total price is $10 USD (plus applicable taxes), we do not offer refunds or prorated returns for any unused portion of the access period other than as expressly stated in Sections 5.1 and 5.2.
If you do not agree to this refund policy, do not purchase access to the advanced scheduler tool.
6. User Conduct & Prohibited Uses
You agree not to:
- Use the Service for any illegal purpose.
- Scrape, copy, or reverse-engineer our data or code.
- Impersonate any person or entity.
- Attempt to bypass login, security features, or payment requirements.
- Share paid-tier login credentials with others.
- Create multiple accounts.
- Use the Service to harass, abuse, or harm others.
- Use the free tier for any commercial purpose (see Section 4.7).
7. Intellectual Property
Our IP: All code, design, text, graphics, scheduling logic, and the advanced scheduler tool are owned by JMH Consulting Services LLC. You may not copy, modify, distribute, or resell any part of the Service without written permission.
Third-party IP: Olympic event names, venue names, logos, and schedules are trademarks of the IOC/LA28. We do not claim ownership of those marks. Our use is for informational and scheduling purposes.
User content: You retain ownership of your itineraries and addresses. By using the Service, you grant us a license to store and display that content to you.
8. Maps & Navigation Features
How it works: When you click "navigate," the Service will open Google Maps or Apple Maps (depending on your device/browser). On desktop, this opens a new browser tab. On mobile, it opens the respective map app.
No guarantee: We do not guarantee real-time traffic accuracy, road closures, or event-specific travel delays. You are responsible for your own travel decisions.
Future location feature: If we later enable real-time location tracking (via progressive web app), you must explicitly opt in. You can disable it at any time.
9. No Warranty & Service Availability
Beta / Pre-Release Disclaimer: The Service is offered as a version 1.0 product. You acknowledge that bugs, downtime, and data loss may occur. We are not liable for lost itineraries, schedules, or user content.
The Service is provided "AS IS" and "AS AVAILABLE."
We do not warrant that event times, venue locations, travel estimates, or the advanced scheduler tool are error-free. Always confirm official Olympic schedules.
We may temporarily suspend the Service for maintenance, updates, or unforeseen issues. No refunds will be issued for temporary downtime except as provided in Section 5.1.
We are not responsible for downtime of Google Maps, Apple Maps, our Payment Processor, or your internet connection.
10. Limitation of Liability
To the maximum extent permitted by law, JMH Consulting Services LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost time, missed events, travel delays, navigation errors, or financial loss arising from use of the Service. Our total aggregate liability for any claim arising out of these Terms or the Service shall not exceed the amount you paid to us in the preceding 12 months, or $10 (whichever is greater).
11. Indemnification
You agree to indemnify and hold harmless JMH Consulting Services LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Service, violation of these Terms, violation of any third-party rights (including Olympic intellectual property), or any dispute regarding payment.
12. Termination
We may suspend or terminate your account at any time for violating these Terms, for non-payment, or for any other reason upon notice. You may delete your account at any time.
Upon termination for violation of these Terms, your paid access will immediately cease, and no refund will be provided (see Section 5).
If we terminate your account without cause (e.g., discontinuation of the Service), we will provide a pro-rated refund calculated from the date of termination to the conclusion of the Olympics.
13. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the State of Connecticut, without regard to conflict of law principles. Any disputes shall first be attempted to be resolved through informal negotiation. If unresolved, disputes shall be resolved through binding arbitration in Hartford, Connecticut in accordance with the rules of the American Arbitration Association (AAA), except that either party may bring individual claims in small claims court. You waive the right to participate in class actions or class-wide arbitration.
14. Changes to Terms
We may update these Terms. Material changes will be posted prominently. Continued use after changes constitutes acceptance.
